Buying
- Prepare or review your Agreement of Purchase and Sale
- Communicate with seller’s lawyer
- Review the draft deed and other documents
- All items included under “Mortgaging” if you are getting a mortgage to purchase your home
- Confirm taxes are paid
- Prepare Statement of Adjustments showing adjusted purchase price
- Certify title
- Deliver funds to seller’s lawyer
- Obtain confirmation from seller’s lawyer that any existing mortgage will be paid out with purchase funds and released
- Prepare Deed Transfer Affidavit
- Record your deed and mortgage (if applicable) and provide you with the originals
- Report to you and your lender
Selling
- Prepare or review your Agreement of Purchase and Sale
- Communicate with the buyer’s lawyer
- Prepare your deed and HST Certificate (if applicable)
- Take all steps necessary to “migrate” your property under the new land registration system including preparing the legal description and searching the title to your property
- Confirm taxes are paid
- Meeting with you to sign deed and other documents
- Request a payout statement from your mortgage company (if applicable)
- Certify title
- Receive funds from the buyer and payout any existing mortgage on your behalf
- Register your Release of Mortgage and provide you with the original registered release
- Report to you
Mortgaging
- Review your commitment letter (if applicable)
- Communicate with your lender
- Prepare your mortgage documents
- Take all steps necessary to “migrate” your property under the new Land Registration Act including preparing the legal description and searching the title to your property
- Confirm taxes are paid
- Arrange for title insurance if necessary
- Meeting with you to sign mortgage and other documents
- Certify title
- Receive funds and pay out any existing mortgage or other debts on your behalf (if applicable)
- Register your Release of Mortgage and provide you with the original registered release (if applicable)
- Report to you and your lender
